Terms and Conditions

§1 Scope of Application

These Terms and Conditions (hereinafter referred to as “T&C”) apply to all orders placed via the online shop and all distance selling contracts of DERMONIQUE GmbH (hereinafter “DERMONIQUE”) in the version valid at the time of the order.

Any deviating terms and conditions of the customer shall not apply unless DERMONIQUE has expressly agreed to them in writing.

DERMONIQUE reserves the right to amend these T&C at any time. The version valid at the time of the order shall apply.

§2 Conclusion of Contract, Ordering Process and Contract Language

(1) The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to place an order.

(2) Customers may place products in the shopping cart without obligation and may cancel the ordering process at any time before submitting the order.

(3) By clicking the “Buy Now” button, the customer submits a binding purchase offer.

(4) A contract is concluded only when:

DERMONIQUE confirms the order by email, or
the ordered goods are dispatched.

(5) The contract language is German. An English version is provided for informational purposes.

§4 Customer Account / Guest Order

(1) Customers may create a customer account or place orders as a guest.

(2) Login credentials must be kept confidential and must not be shared with third parties.

(3) In the case of guest orders, personal data will be processed solely for contract execution and stored in accordance with statutory retention obligations.

§5 Prices, Shipping and Delivery

(1) All prices are stated in Euro (€) and include statutory VAT, plus shipping costs.

(2) The price valid at the time of order shall apply.

(3) Delivery shall be made to the address provided by the customer.

(4) Delivery is available within Germany and, where offered, within the European Union.

(5) Partial deliveries are permissible insofar as they are reasonable for the customer.

§6 Payment Methods

DERMONIQUE offers the payment methods displayed in the online shop (e.g. credit card, PayPal, advance payment, invoice).

DERMONIQUE reserves the right to exclude certain payment methods in individual cases.

§7 Right of Withdrawal

Consumers within the meaning of Section 13 of the German Civil Code (BGB) have a statutory right of withdrawal of 14 days.

The right of withdrawal does not apply to:

sealed cosmetic products if the seal has been removed after delivery,
personalized or custom-made products,
products which are not suitable for return for reasons of health protection or hygiene.

A detailed withdrawal policy including a withdrawal form is provided separately.

§8 Returns

(1) Returns must be registered with DERMONIQUE customer service in advance.

(2) In the event of a valid withdrawal, DERMONIQUE shall bear the return shipping costs, provided that a return label supplied by DERMONIQUE is used.

(3) Opened, used or unsealed products are excluded from return unless a material defect exists.

§9 Warranty and Liability

(1) Statutory warranty rights apply.

(2) DERMONIQUE shall be liable without limitation in cases of intent or gross negligence.

(3) In cases of slight negligence, DERMONIQUE shall only be liable for breaches of essential contractual obligations and only for foreseeable, typical damages.

(4) Liability for injury to life, body or health and liability under the Product Liability Act remain unaffected.

§10 Retention of Title

The delivered goods remain the property of DERMONIQUE until full payment has been made.

§11 Personalized and Professional Products

(1) Personalized products are excluded from exchange and withdrawal.

(2) Products labeled “Professional Use Only” are intended exclusively for use by trained professionals. DERMONIQUE assumes no liability for improper or unauthorized use.

§12 Intellectual Property Rights

All content, texts, images, designs and trademarks displayed in the online shop are protected by intellectual property law.

Any use without prior written consent of DERMONIQUE is prohibited.

§13 Data Protection

Personal data is processed in accordance with DERMONIQUE’s Privacy Policy, available at:

§14 Governing Law

German law shall apply, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).

§15 Dispute Resolution

DERMONIQUE is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
